ANTHONY DAVIS: NBA 1st ROUND PICK MAY MISS OLYMPICS DUE TO INJURY

New Orleans power forward Anthony Davis, the No. 1 pick in last week’s NBA draft, suffered a sprained ankle in a Hornets workout Saturday that may eliminate him from consideration for the Summer Olympics in London. The Hornets confirmed Davis’ injury in a statement, saying he was day to day and that his availability to train with Team USA would be determined later this week.

ESPN.com reported last week that Davis was set to join Clippers forwards Blake Griffin and Lamar Odom in auditioning for U.S. coach Mike Krzyzewski in Las Vegas on Wednesday, two days before the rest of the U.S. hopefuls are scheduled to arrive for training camp. USA Basketball is expected to announce its 12-man Olympic roster on Saturday.

If Davis is ultimately scratched from Team USA’s plans, he would join a lengthy list of players who have been ruled out by injury. That group includes Bulls point guard Derrick Rose (knee), Magic center Dwight Howard (back), Clippers point guard Chauncey Billups (Achilles), Trail Blazers power forward LaMarcus Aldridge (hip), Heat shooting guard Dwyane Wade (knee) and Miami power forward Chris Bosh (abdominal strain).

Lakers center Andrew Bynum — who would have been a natural fit to replace Howard — passed on the opportunity to join Team USA because he plans to have the same platelet-rich plasma therapy on his knee that teammate Kobe Bryant had last offseason. Davis, who led Kentucky to the national title as a freshman, and Thunder shooting guard James Harden were added to the list of roster finalists in early May to compensate for injuries.

Team USA chairman Jerry Colangelo was unsure of the specifics of Davis’ injury as of midday Monday.

“I heard that Anthony Davis sprained his ankle … but I don’t know how serious it is,” Colangelo said. “It was in a workout. I’m not going to worry about that unless I’m advised at this point.”

Seconds later, Yahoo! Sports reported that Davis’ injury was severe and that he was likely to forgo the Team USA experience. Colangelo, when again reached by SI.com, said that he would need to know more to get clarity.

“Just getting a [media] report that his ankle is serious doesn’t mean anything to me until we get an official doctor’s report on what that means,” he said. “Does it mean he can’t practice for a week? Does it mean he’s out for a month? You know what I’m saying. I don’t like to speculate.”

Because Colangelo originally opted to leave two vacant spots on the list of roster finalists submitted to FIBA in early May, it remains unclear whether he would be permitted to make more additions in light of Davis’ injury.

“I’m not 100 percent certain,” Colangelo said. “So that will be another call.”

Along with Davis, Griffin, Odom and Harden, the rest of the finalists are Knicks small forward Carmelo Anthony, Bryant, Knicks center Tyson Chandler, Thunder small forward Kevin Durant, Grizzlies small forward Rudy Gay, Hornets shooting guard Eric Gordon, 76ers small forward Andre Iguodala, Heat small forward LeBron James, Timberwolves power forward Kevin Love, Clippers point guard Chris Paul, Thunder point guard Russell Westbrook and Nets point guard Deron Williams.

Davis was seen as a possible 12th man as it was — team officials view Griffin, Love and Chandler as the primary rebounders, while Anthony, Durant and James have the ability to play power forward — so Colangelo may not be inclined to expand his roster even if an amendment is allowed. If he does, however, Sacramento center DeMarcus Cousins is itching to fill the void left by Davis. Cousins, already a member of the Select team that will train with and compete against the Team USA finalists in Las Vegas, has been vocal about his plan to play his way onto the London squad.

“I’m not going [to Las Vegas] just to practice,” Cousins told local media in early June. “I can make that team.”

His agent, John Greig, is hopeful that his client will be considered.

“DeMarcus feels like the [Team USA] consideration is high prestige,” Greig said. “It’s a high-quality organization, but in the interests of USA Basketball, I know that DeMarcus has a lot of passion about his desire to prove himself worthy this go-round.

“I would believe that if unforeseen injuries occurred, that FIBA would be more likely to allow adjustments to the roster and at that point they would look at all options.”

Jazz power forward Derrick Favors, another member of the Select team, could also be considered.

CHICK-FIL-A, FAST FOOD GIANT GOES TO WAR WITH ONE-MAN BUSINESS

Bo Muller-Moore sells $25 hand-stenciled “Eat More Kale” T-shirts that he cranks out one at a time in his Vermont home, and this has ruffled the feathers of Chick-fil-A.

The fast-food chain, which rang up $3.5 billion in sales in 2010, is trying to put Muller-Moore out of business—for the second time in five years. Chick-fil-A, which is second only to king-of-the-fast-food-coop KFC, considers him a threat to the brand.

Chick-fil-A says Muller-Moore’s T-shirt business, founded in 2000, infringes on its trademarked slogan “Eat Mor Chikin.” It’s a [deliberately-misspelled] advertising campaign the Atlanta-based chain launched in 1995 and, according to the company website, changed the burger-eating landscape forever. The message “reaches millions—on television, radio, the Internet, and the occasional water tower,” explains the website. (The closest Chick-fil-A to Vermont is in Nashua, N.H., more than 120 miles away.)

Chick-fil-A first came after Muller-Moore in 2006, with a letter demanding that the artist—who also posts screenprinting instructional videos at eatmorekale.com—cease and desist from printing T-shirts and send Chick-fil-A any inventory.

“Man, it knocked the wind out of me,” Muller-Moore, 39, told the Burlington Free Press. “I make my living as a foster parent. At the time, I had one small child. I now have two of my own. My business has grown every year. I’m certainly not getting rich. I can’t live on it. It’s the foster parenting gig that pays the bills, but that said, the business is growing every year. I’m in it for the long haul.”

Muller-Moore applied to the Vermont Arts Council for free legal help, and a lawyer wrote some letters on his behalf. It seemed Chick-fil-A backed down. But then in August Muller-Moore applied for a U.S. trademark for “Eat More Kale” to use the phrase on a range of clothing and stickers.

Chick-fil-A cried fowl. In October of 2011 the company’s lawyers sent a letter to Muller-Moore, noting that the company owns numerous U.S. and international trademarks and copyrights for both “Eat Mor Chikin” and for cows holding sandwich-boards reading “Eat Mor Chikin.”

“Your client’s Eat More Kale Mark plays off of and imitates Chick-fil-A’s valuable ‘Eat Mor Chikin’ Intellectual Property by using a prefix confusingly similar to Chick-fil-A’s federally-registered ‘Eat Mor Chikin’ trademarks,” Chick-Fil-A’s lawyer wrote to Muller-Moore’s, according to the Free Press. “Your client’s misappropriation of Chick-fil-A’s ‘Eat Mor Chikin’ intellectual property, to play off of and benefit from the extraordinary fame and goodwill of Chick-fil-A’s trademarks, copyrights and popular promotional campaign, is likely to cause confusion of the public and dilutes the distinctiveness of Chick-fil-A’s intellectual property and diminishes its value. Such actions constitute trademark infringement, dilution and unfair competition in violation of federal and state law.”

The six-page letter notes that Chick-fil-A has successfully defended against 30 other “Eat More” phrases, including “Eat More Goat” and “Eat More Beer,” and says the chicken chain has won lawsuits against Burger King Corp. and others. (In 2000, Chick-fil-A objected to a Burger King ad where animated poultry from the film Chicken Run held up signs reading “Save the Chickens: Eat a Whopper.”)

The letter asks that Muller-Moore abandon his trademark application, “cease and forever desist” all plans to use the phrase “Eat More Kale” for his business—and transfer the eatmorekale.com domain name to Chick-fil-A. (It says the chicken chain would not object to Muller-Moore using “Eat Kale” or eatkale.com.”)

Muller-Moore’s lawyer has fired off a five-page response, which observes that no one is likely to confuse the two slogans.

“My client’s phrase shares only six out of twelve of the same letters as your client’s phrase and none of the imagery or conceits,” Richardson writes. “My client has no cow designs which appear in conjunction with the phrase ‘Eat More Kale.’”

Whether one is likely to be confused with the other may be less at issue than whether Chick-fil-A can be seen to be lax in its defense of its own trademarks.

“If a trademark owner fails to protect their trademark, they run the risk of losing it,” wrote Steve O’Donnell, a Lancaster, Pa., trademark attorney, of a 2010 case where Chick-fil-A complained about an Orlando area fruit and vegetable market using the slogan “Eat More Produce.”

MIKE TYSON HEADED TO BROADWAY WITH “UNDISPUTED TRUTH”, A ONE MAN SHOW

Mike Tyson is making the popular move from the big screen to Broadway with his one-man show, “Mike Tyson: Undisputed Truth.”

The production, under the direction of Spike Lee, will play at the Longacre Theatre for six nights only starting July 31.

According to a website for the show, “Mike Tyson: Undisputed Truth” is “a rare, personal look inside the life and mind of one of the most feared men ever to wear the heavyweight crown.” The site also assures ticket holders that they’ll be treated to a “riveting one-man show [that] goes beyond the headlines, behind-the-scenes and between the lines to deliver a must-see theatrical knockout.”

Tyson performed the show in Vegas earlier this year, and he told CNN at the time that “Undisputed Truth” is compiled from “the stories of my life that were basically in the headlines,” but also “the underlining story: My relationship with my wife, my conviction, my upbringing, the death of my mother … just who I was as a child back  then, and who I am now.”

According to Playbill.com, “Mike Tyson: Undisputed Truth” was written by his wife, Kiki Tyson, and director Randy Johnson, and shows the good and the bad of Tyson’s history. The boxer said in a statement that to share the “highlights and lowlights of my life with New York is especially important to me as I was born and raised in Brooklyn.”

And according to director Lee, Tyson is a “great storyteller,” as he said in a statement.

“Human beings want to hear stories. Whether it’s a play, a documentary … a song, a musical, a novel or a movie, we love to hear stories,” Lee said. “And, with Mike Tyson on stage, you are going to hear a great American story.”

I JUST GOT BOOKED AS A CELEBRITY JUDGE ON A BRAND NEW SHOW ON TV-ONE

Today started just like any other. Actually, not like any other day…I’m not sick anymore! That’s new for me at this moment. Have to be thankful for that. I got up, walked the dog, fed the dog and fed myself. I then checked my email. In my email, I received a message informing me that I just got booked on a huge new show on the TV One network. I can’t mention the name of the show right now because it is currently being shot. Stay tuned for more updates regarding this news. For those of you outside the US, TV One is a network owned by Comcast,  one of the biggest cable companies in the world. I’m really excited. The message also said that all the exec’s at the Network are excited about the possibility of me guesting on this huge series for them. I fly out to Atlanta tomorrow.
